I mean that they assume fast growth in sales once they finish project XYZ. Their financial projections show incredible growth. Of course, we are skeptical but our team cannot agree on how to best forecast growth. I'd like to know if there are norms or quantitive data about growth rates out there that we could use in our models to come up with a better valuation.

With so many lease agreements for different pieces of equipment, it does not make sense to track our "lease agreements," because that is too general. We would like to distinguish the contracts or leases in some way other than by type of contract. They are still leases after all. Is there a way to track contracts by the type of equipment or subject of the contract?

Our company is an established printer with a long history. We are quite profitable relative to our peers. It is obvious, however, that the printing industry in general is in decline. We are also noticing that clients are ordering less volume. So far we have been able to hold prices but the early indicators from our sales team is that we will see push back on our prices next quarter. All of our management discussions focus on efficiency and optimizing equipment utilization. It seems like we should be looking at a significant strategic alternatives. For example exiting the publishing business or acquiring competitors.

  • Why is the royalty payment under our contract not considered a royalty for tax purposes?

    bookmark_border 0

We provide services to customers using a product sold by a company we are partnering with. We negotiated a contract where we provide those services at a reduce rate and the company pays us a royalty on sales of the product as compensation for the reduced service rate. Our auditors have told us that the income we receive from these royalty payments is taxable as ordinary income rather than at the lower tax rate for royalties, but we are struggling to understand why.

We want to make our contracts more useful to managers throughout the company. Full text search of contract files does not actually help them get what they need because it often shows too many or too few results. Even if they find a useful provision, the manager still has to interpret the language, which is the job of our legal department. Is there a way to track provisions in a more structured and consistent manner that would show on a report? We would like to show the obligations or requirements across our contract portfolio.

We have an internal software development team. They develop new products, but they also maintain existing products. What costs get capitalized? Does all development for new products get capitalized? Is there any discretion. For example, if the product is an add-on to an existing solution, does that matter. We would prefer to take the expense in the current year to reduce taxable income, but I'm not sure if that is permitted. What about the maintenance work?
